By using JOY OURS services and products, the hirer agrees to these Terms and Conditions. JOY OURS reserves the right to amend these Terms and Conditions at any time. Any amendment is effective immediately.  

1. Minimum Hire Period: The minimum hire period is two (2) weeks.

2. Hire Commencement: Hire starts from the delivery date and is billed fortnightly in advance. Hire will automatically continue unless otherwise notified.

3. Deposit Requirement: A refundable deposit of 10% of the item’s retail price (minimum $20) is required per item.

4. Initial Payment: Covers the deposit and two weeks’hire per item.

5. Payment Methods: bank transfer.

6. Ongoing Hire Fees: Further hire fees are invoiced every two weeks in advance.

7. Ownership and Responsibility: All equipment remains the property of JOY OURS. The hirer is responsible for the care, cleanliness, and safe use of the equipment during the hire period.

8. Condition of Return: Equipment must be returned in clean, good working condition. Additional fees may apply for repairs or excessive cleaning.

9. Loss or Damage: The hirer may be charged the full replacement value for any lost or damaged equipment.

10. Malfunctions: In the case of equipment malfunction not caused by misuse, JOY OURS will provide repair or replacement within a reasonable timeframe.

11. Late Payments: All invoices must be paid by the due date. Late payments may attract a late fee.

12. Liability: JOY OURS is not liable for injuries or damages caused by misuse or unauthorized operation of the equipment.

13. Termination: Either party may end the agreement with written notice. Equipment must be returned promptly.

14. Disputes: Any disputes will be resolved through mediation, followed by legal proceedings under Victorian law if unresolved.

15. Interest on Hire: An annual interest rate of 6% applies to the retail value of each item during the hire period.Interest is calculated on a pro-rata basis (based on the length of hire) and is payable in full at the time of purchase or return of the equipment. Interest is not deductible from the final purchase price.
